City Asks Court To Review Decision & To Certify Question To Florida Supreme Court
Updated September 25, 2007
The City appropriated another $20,000 dollars of taxpayer money to ask the 3d DCA to review the boards holding en banc; a review of the case by all of the judges. The City also asked the Court to certify the question to the Florida Supreme Court as a matter of “great public importance.” If the City loses again at the 3d DCA they will most certainly appeal the issue the Florida Supreme Court which will cost the taxpayers of the City ~ $50,000 which will bring the litigation bill totals to close to $200,000. All this money wasted on a $50 parking ticket; they should have torn it up as the trial judge suggested. It would have saved the taxpayers a lot of money.
Leading the charge in the battle of the $50 parking ticket is the City’s inept mayor, Don Slesnick. His Chicken Little attitude toward pick-up trucks in Coral Gables after 7pm would be comical if it wasn’t costing the taxpayers of the City hundred of thousands of dollars. Hey Don, where is the evidence that pick-up trucks lower property values? Coconut Grove allows them and their property values are just as high as the Gables. You can park a personal use pick-up truck in front of your home in Beverly Hills, Ca. How about producing a recent scientific study that backs up your claim before you spend another 100K trying to convince everyone the sky is falling (property values in this particular case). Don, be a responsible mayor.
I have made the City’s court documents available under the Court Documents tab at the top of the site. I have also made our responses to the City’s requests available.
Note: I passed the Florida Bar!!! Now I am waiting on my background check to clear; could happen any day. Litigation against the City of Coral Gables is an area of law that I have a keen interest in, and a proven track record.
Kerns v. City of Coral Gables
John Kerns, a resident of Coconut Grove has enlisted the services of attorney Spencer Kuvin, of Leopold & Kuvin, to represent him against the City of Coral Gables in a lawsuit similar to mine. John's father Jack is a resident of the City of Coral Gables and has had some health issues which required John to come over and assist him at night. The only problem is that John drives a pick-up truck which has been ticketed numerous times by CG Code Enforcement. John called and tried to explain to the Zoning Officer that his father, on occation, needed his help due to a serious illness.
